These Terms and Conditions and the Privacy Policy Statement are subject to the POPI Act (“the Act”) and requires the implementation of the Eight Conditions for the Lawful Protection of Personal Information in terms of the Act.

Processing of personal information

We will only process personal information insofar as it is necessary to ensure that the website operates optimally (see “Cookies” below), and where you provide your consent by supplying personal information to us, namely:

• when you complete our pre-admission form online,
• log any queries via our website,
• complete any forms on our website; and/or
• complete surveys on our website.

Sharing / disclosure

We will not share or disclose the personal information we collect and process by means of our website with Third Parties without your permission, other than outlined below. It will only be used for the purposes stated above, namely to ensure the proper functioning of the website, as per your chosen cookies (see below), to allow you to complete a pre-admission form online before our visit to hospital and to lodge queries with us.

The Patient Pre-admission Form constitutes part of your health record, and its confidentiality is protected under healthcare professional legislation and the National Health Act. Your medical scheme information, and the basic clinical information may be used to ensure pre-authorisation by your medical scheme, if you have requested that we provide assistance with that. The information collected as part of the pre-admission process allows us to plan for your healthcare needs, to ensure that the necessary financial and funding arrangements and obligations can be met, and to obtain information on next of kin for healthcare consent purposes.

We may disclose your Personal Information only if required to do so by law or in the good-faith belief that such action is necessary to:

1. conform to the law or comply with legal process served on the Advanced Health Group or its website;
2. protect and defend the rights or property of the Advanced Health Group and its website; or
3. act in urgent circumstances to protect the personal safety of employees of the Advanced Health Group, patients and other users of our services or members of the public.

The Advanced Health Group may collect statistics about the behaviour of visitors to its website. We may share this information with other parties, where necessary. We collect IP addresses for the purposes of system administration and to audit the use of the Website. We do not link IP addresses to personal information, which means that your session will remain anonymous.

Security

Where we have processed your personal information as outlined in this document, we use a variety of security technologies and procedures to help protect your Personal Information from unauthorised access, use or disclosure. For example, we store the Personal Information you provide in computer servers with limited access that are located in controlled facilities. This website is hosted by xneelo and the following security measures have been implemented: Implement and maintain appropriate technical and organisational measures to protect the security and confidentiality of the personal information; hosting of a secure server environment that uses a firewall and other advanced security measures to prevent interference or access from outside intruders; all personal information is securely stored in customer database; only  those employees who require it to fulfil their job responsibilities have access to personal information; disaster recovery procedures are implemented where appropriate. Although we take all reasonable steps to ensure that our website will be secure, we will not be liable for any unavailability, interruption, downtime, malfunction, or failure of the Website for any reason whatsoever. We are also unable to guarantee that the website is free of viruses, destructive materials or any other data or code which is able to harm or otherwise impede in any manner the operation of a computer system, computer network or your hardware or software and you accept all risks in this respect. 2. Notification if there has been unlawful access or acquisition of your personal information;
3. Request a record of their Personal Information;
4. Request the correction, deletion and/or destruction of your Personal Information;
5. Object to the processing of Personal Information;
6. Exercise the right to withdraw the consent to processing, if voluntarily given (i.e. if not required by a law);
7. Not be subjected to unsolicited electronic communication and/or marketing, unless the you are a customer, patient or user with whom we have a sales or service record, or the person has consented to the communication and the person has had an opportunity to object to the communication;
8. Not to be subjected to automated decision-making based on the personal information in contravention of section 71, POPI Act, i.e. where information is used to for example decline benefits or services automatically;
9. Submit a complaint to the Information Regulator; and
10. Institute civil proceedings regarding an alleged interference with his/her/its personal information in terms of section 99, POPI Act.
